MOMENTUM IN-PERSON BUSINESS DAY
TERMS & CONDITIONS
This Agreement is between Kirsty Holden (“the Event Provider”), and you (“the Attendee”).
By purchasing a ticket, you agree to the following terms.

1. Event Description
You are purchasing access to two or more Momentum In-Person Business Days, structured working days designed to support clarity, decision-making, and strategic focus away from day-to-day client work.
Each event may vary in:
• location
• agenda
• group size
• facilitation format
Specific details will be provided prior to each event.
This is not a coaching programme, membership, or ongoing service.
2. What’s Included
Your ticket includes:

Attendance at the specified in-person event (2 or 4)
Facilitated working time and guidance
Group discussion and peer environment
Lunch
Tea, coffee and light snacks throughout the day
Dietary requirements will be accommodated where possible but cannot be guaranteed.
Full details will be requested in advance.
3. Payment & Commitment
• This is a 12-month fixed-term event subscription
• You agree to a minimum 12-month commitment from the date of purchase
• Payments are made monthly in equal instalments
• Monthly payments are instalments of the full annual fee, not a cancel-anytime subscription
By enrolling, you commit to the full 12-month term, regardless of:
• attendance
• ability to attend specific dates
• changes in personal or business circumstances
Payment secures your place across the specifically booked/scheduled in-person Momentum Business Days during your 12-month term.
If a payment is missed:
• access to future events may be suspended
• the outstanding balance remains payable in full

4. Cancellations, Transfers & Non-Attendance
Change of Mind / Inability to Attend
If you cannot attend a scheduled event for any reason:
• your payment obligation continues
• no refunds or credits are issued
• no replacement service is provided
Your subscription will cover either access to the whole event series OR attendance at specific dates.
Transfers
At the Event Provider’s discretion, you may request:
• a transfer of a specific event to another named individual or
• a transfer to a future event date within your active subscription term
Transfers:
• are not guaranteed
• must be requested in writing
• may be subject to reasonable conditions
No transfers will be offered outside your active 12-month term.
Refund Policy
All payments made under this agreement are non-refundable, except where required by law.
No refunds, credits, or partial refunds will be issued for:
• non-attendance
• missed events
• changes in personal or business circumstances
• dissatisfaction with the experience
• inability to attend specific dates
5. Event Changes
Location
Event locations are confirmed in advance and will not change except in exceptional circumstances.
In the unlikely event a location change is required due to circumstances outside the Event Provider’s reasonable control (including but not limited to severe weather, venue closure, transport disruption, or illness):

• any alternative location will be within reasonable travelling distance
• changes will be communicated as soon as reasonably possible
• where appropriate, changes will be made with the agreement of the group
A change of location does not constitute grounds for cancellation, refund, or suspension of your subscription.

Event Adjustments
The Event Provider reserves the right to:
• adjust timings or agenda
• substitute facilitators where necessary
These changes do not constitute grounds for cancellation, refund, or suspension of your subscription.

Minimum Attendance & Event Viability
Each in-person Momentum Business Day is subject to a minimum number of confirmed attendees in order to run effectively.
If, in the Event Provider’s reasonable judgement, this minimum commitment is not met for any scheduled event, the Event Provider reserves the right to cancel that event.
In the event of cancellation by the Event Provider due to insufficient attendance, affected Attendees will be offered either:
a full refund for the cancelled event day(s), or
the option to transfer their booking to an alternative in-person Business Day within their active 12-month subscription term (if available).
Where possible, notice of cancellation will be given as early as reasonably practicable.
This clause applies only where an event is cancelled by the Event Provider.
It does not affect the non-refund policy outlined in Section 4 for non-attendance or change of mind by the Attendee.

Rescheduling
If an event must be rescheduled due to circumstances outside the Event Provider’s reasonable control (including but not limited to severe weather, venue closure, transport disruption, or illness):

• reasonable efforts will be made to reschedule the event within your active 12-month subscription term, or

• the event may be replaced with an alternative event of equivalent value
Refunds will not be automatically issued for rescheduled or adjusted events.
Any refund, credit, or alternative remedy (if offered) will be:
• proportionate
• discretionary
• determined by the Event Provider
This will be the sole remedy.
6. Conduct
You agree to:
• behave respectfully
• maintain confidentiality
• contribute to a safe, inclusive environment
The Event Provider reserves the right to remove any attendee whose behaviour is disruptive, inappropriate, or harmful.
No refund will be issued in such cases.
7. Intellectual Property
All materials, frameworks, and facilitation methods remain the intellectual property of Brains Behind the Business® or Kirsty Holden.
You may not record, reproduce, distribute, or repurpose content without written permission.
8. Liability
Attendance is at your own risk.
To the fullest extent permitted by law, the Event Provider accepts no liability for:
• loss or damage to personal property
• indirect or consequential loss
